USING THE SITE AND/OR APPLICATION

You may only use the Site for personal use. Any commercial use by you of the Site is strictly prohibited. You are permitted to print individual web pages on an occasional basis provided that you do not print the whole or a substantial portion of the Site and that the trade marks and intellectual property notices included on the Site are not removed.


Unless otherwise stated in these Terms and Conditions, you must not (whether directly or indirectly) (i) copy, download, store, make available, distribute, sell or offer to sell all or any part of the content or Site or Application, or (ii) download or otherwise copy any content, files or data from the Site to make or populate a database or publication of any kind whatsoever.

REGISTRATION

You must be at least 18 years old to register and submit comments or photographs through the Site.


You must not register more than one account.


You must provide an up-to-date email to which you have regular access as we may need to contact you regarding your submissions.


You must not: impersonate or try to impersonate another person; disclose your password to anyone else; allow anyone else to use your account; or use anyone else's account. You are responsible for all submissions made through your account. YOUR CONTENT – WHAT WE ARE ALLOWED TO DO

We reserve the right to publish, edit or remove all or part of any content you submit including but not limited to any details contained within your profile (e.g. your name, town, country), any photographs or any comments you may have submitted ("Your Content").


Please note that by submitting content through the Site you are consenting to any images you provide being uploaded to Google Images or any other search engine selected by us.


By submitting content to the Site, you grant us a perpetual, royalty-free, worldwide, irrevocable, non-exclusive licence to use, copy, edit, adapt, publish, translate, make available, communicate, distribute and sub-licence Your Content (in whole or in part) for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you through the Site constitutes a violation of their intellectual property rights, or of their right to privacy. By submitting Your Content you warrant that you have the right to grant this licence and you indemnify us for any breach of that warranty. SUSPENSION OR TERMINATION OF ACCOUNT

We may suspend and/or delete any user account at our sole discretion. The main reasons for which an account may be suspended or deleted are: the user failed to comply with the Guidelines or these Terms and Conditions; and/or any comment submitted by the user account was deemed inappropriate. We will notify you of any suspension by email at the address you provided during your registration or at the next time you attempt to access your account. The length of suspension or the decision to delete an account will depend on the circumstances. If your account is suspended or deleted you must not attempt to re-register or submit content through another account without our prior written consent.

INDEMNITY

You will indemnify us and keep us indemnified against all losses, expenses, costs and liabilities which arise as a result of or in connection with your breach of these Terms and Conditions.

TRANSACTIONS CONCLUDED THROUGH THE SITE

Contracts for the supply of goods formed through our Site are governed by our Terms and Conditions of Supply.


Unauthorised re-sale of Jo Loves products is prohibited.

ONLINE DISPUTE RESOLUTION

Consumers who have a problem with a trader regarding a product or service bought online may settle the dispute through the European Commission’s Online Dispute Resolution (“ODR”) procedure. Should you have a problem with any of our products or services, you may access the ODR platform here.

Where the Site or Application contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the content of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.


Unless otherwise stated, we are not commercially associated with any third party products which are referred to on our Site or in the Application.

OUR LIABILITY

The material displayed on our Site is provided without guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude: all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use, inability to use or results of the use of the Site, any websites linked to it and any materials posted on it, including loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, or wasted management or office time whether caused by tort (including negligence) breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories above. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.


Our total liability (if any) for all damages, losses, costs and expenses under whatever causes of action, whether in contract, tort or otherwise will not exceed £5 million.

ACCESSING THE SITE

Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable if for any reason our Site is unavailable at any time or for any period.


The Site relies in part on software to work. Software has bugs. Whilst we will monitor the Site and try to fix bugs, we cannot guarantee that the Site or any individual feature of the Site will be error free, available all the time and/or free from viruses.

NO WARRANTIES

We provide no warranty, whether expressly or implied, of any kind including but not limited to any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose or non-infringement. All such implied terms and warranties are hereby excluded.

CHANGES TO THE SITE OR APPLICATION

We reserve the right to change the content of the Site at any time. If the need arises we may suspend access to the Site or close it indefinitely. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.

VALIDITY

ENTIRE AGREEMENT

These Terms and Conditions, the Guidelines and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these Terms and Conditions. We each acknowledge that neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these Terms and Conditions, the Guidelines or the documents referred to in them. Each of us acknowledges and agrees that the only remedy available to it for breach of these Terms and Conditions shall be for breach of contract under these Terms and Conditions. Nothing in these Terms and Conditions, however, operate to limit or exclude any liability for fraud.

JURISDICTION AND APPLICABLE LAW

These Terms and Conditions are governed by English law. The English courts shall have exclusive jurisdiction over any dispute relating to these Terms and Conditions.

JO LOVES GIFT CARDS

Gift Cards purchased on Joloves.com will expire after 1 year from purchase. If you have any questions regarding your Gift Card, please contact advice@joloves.com.


Promo codes of A Fragrance Discovery Collection to redeem your full-size Fragrance expire after 12 months from purchase. These codes are valid on all 100ml Fragrances up to the value of £115, if redeeming on a Limited-Edition Fragrance you will be required to pay the price difference. 

WARRANTY

If your Jo Loves product is within one year of purchase and becomes faulty, please contact advice@joloves.com for assistance. We will unfortunately not be able to exchange or refund past this date.

JO LOVES SCENT ARTIST CLUB TERMS AND CONDITIONS

The following terms and conditions apply to and govern the Jo Loves Scent Artist Club.

These terms and conditions, together with our website T&Cs and our Privacy Policy apply to the Jo Loves Loyalty Programme (the "Programme") and govern the relationship between Jo Loves and you. Signing up for the Programme will constitute acceptance of these terms and conditions.

  1. All Programme applicants must be individuals aged 18 years or older. Members will be able to update their personal details online at joloves.com Members may opt out of direct marketing or request deletion of your personal data held by us in accordance with our Privacy Policy.
  2. The Programme is only for personal and consumer use. Red Dots can only be earned, held, or transferred as set out in these terms and conditions, or in the terms relating to any promotions and offers related to the Programme, and may not be earned, held or transferred, or otherwise traded in any other way.
  3. We reserve the right to suspend or to terminate any Member's Programme account if, in our sole discretion, we consider that the Member has breached the terms and conditions, supplied false or misleading information, or acted improperly or in an abusive, defamatory, criminal, or offensive way to any other Member or to our staff.
  4. Members will accumulate Red Dots when they make qualifying Jo Loves purchases or complete qualifying actions. Red Dots expire on a rolling year. Red Dots will expire 12 months after the latest interaction with the loyalty programme.

  5. The following terms shall apply to every Member's accumulation and use of Red Dots: if a Member is given a refund or other financial adjustment on any transaction, the Red Dots awarded on the transaction will be adjusted accordingly; you can check your Red Dots balance at any time online Red Dots have no cash value;
  6. The following terms shall apply to the redemption of any Red Dots: Members can redeem Red Dots in-store and online upon reaching the qualifying level; Jo Loves employees, sub-contractors and/or their agents may not participate in the Programme. We may terminate any Member's Programme account should the account be inactive for a period of 24 months or more. Any Red Dots that were accredited to a Member's Programme account will be lost if the Member's Programme account is terminated or the Programme is closed. A Member can terminate his or her Programme account at any time online at joloves.com or by notifying us by email at advice@joloves.com.
  7. Account information will also only be available to Members online at joloves.com. We will correct an account if it is shown to our reasonable satisfaction to be wrong but, unless there are clear records showing this, our decision is final.
  8. Red Dots are personal to an account and cannot be transferred or combined with another account to redeem a reward.
  9. Jo Loves may amend the Benefits it offers Members at any time.
  10. By registering for the Jo Loves Loyalty Programme you have the option to agree to us contacting you by e-mail, post or telephone with promotional offers, competitions, news and updates. We process your data in accordance with applicable laws and in accordance with our Privacy Policy and our website T&Cs.
  11. We cannot be responsible for any unauthorised use of Red Dots.
  12. These terms and conditions may change and Members will be deemed to have accepted the updated terms and conditions when they go online at joloves.com. As such we strongly encourage you to review these terms and conditions from time to time.
  13. We may suspend or terminate the Programme at any time at our sole discretion and for any reason. In such event, Members will be notified and all accounts will be suspended or terminated.
  14. The limit of our liability under these terms and conditions will be exclusive to a Member who suffers a direct loss as a result of our breach of these terms and conditions and in those circumstances, our sole liability will be to credit to the relevant Members Programme account such Red Dots as may have been wrongly deducted or should have been credited but were not. Nothing in these terms and conditions shall operate to limit any liability we may have for death, personal injury or fraud. These terms and conditions shall prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
  15. These terms and conditions and any dispute, claim or non-contractual obligations arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the law of England and Wales and you irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions or their subject matter.
